Minutes:

NOTED

 

1.         Councillor Delman left the room and took no part in the consideration of the application or the vote.

 

2.         The Head of Development Services’ introduction, advising that previous reasons for refusal had been overcome, but that it had not been satisfactorily demonstrated that the scheme could not support affordable housing. Officers considered that six affordable units would be suitable within this application.

 

3.         Councillor Pearce arrived at the meeting after the officer's introduction had begun and was therefore not permitted to vote on this application.

 

4.         The deputation of Mr Nigel Killane, Co-Director of Alburn, the applicant, including the following points:

(i)  Alburn was a private company; Alburn Retail had been very active in the UK in the last two years and had developed a number of similar sites for retail and roadside housing. None had involved an appeal or prolonged negotiations.

(ii)  Work began on this proposal in 2007, with pre-planning and discussions taking place before submission of the first application in October 2008.

(iii)  It was a clear principle that social and affordable housing contribution would be demonstrated via a 3 Dragons Toolkit.

(iv)  The reasons for refusal of planning permission in 2008 related to access, parking, overlooking, housing layout and mix. These issues were resolved and a second application submitted.

(v)  When a decision was deferred in July 2009 due to concerns raised by the Housing Department about the housing mix, there was re-engagement and amendments were made, and a third 3 Dragons Toolkit test was submitted.

(vi)  The applicant was informed of a requirement for six affordable housing units on 7 October 2009, and would contest this as it was not substantiated by the 3 Dragons Toolkit accepted previously.

(vii)  The applicant had been frustrated by the lack of engagement with Housing Department officers and had been seeking dialogue to no avail.

 

5.         At the Chairman's request, Planning officers provided an explanation of the '3 Dragons Toolkit'.

 

6.         The response of Mrs Christine Williams, Hon. Sec. Private Road Residents' Association, including the following points:

(i)  In principle the development was welcomed as it would be an improvement on the current and deteriorating use of the site.

(ii)  Residents were concerned about the movement and control of vehicles and parking in Private Road.

(iii)  Residents objected to the access cutting across Private Road, which would be hazardous for traffic.

(iv)  There would be problems with refuse lorries in this congested area.

(v)  There should be an undertaking on the maintenance of the right of way.

(vi)  Inclusion of a clock in the design would have been welcomed for aesthetic and historical reasons.

 

7.         The response of Mrs Inigo-Jones, Castleleigh Court resident, including the following points:

1.         An alteration to the recommendation.

 

2.            Receipt of a letter from the Friends of Broomfield Park in support of the proposal.

 

3.            Confirmation that Conservation Advisory Group supported the officers' recommendation, and that the greenhouse had no use and no historical resonance.

 

AGREED that in accordance with Regulation 12 of the Planning (Listed Buildings and Conservation Areas) Act regulations 1990, the Head of Development Services be authorised to make an application to the Secretary of State for Communities and Local Government to seek consent for the proposed works, subject to the conditions set out in the report to any approval, for the reason set out in the report.
