DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non-pecuniary interests relevant to items on the agenda.

Minutes:

The following interests were declared at the meeting:

 

Agenda Item 7: Petition – Protection of the Green Belt Land and Wildlife at Enfield Road

 

·                Councillors Lee David-Saunders, Alessandro Georgiou, Joanne Laban, Michael Lavender, Dino Lemonides, Terence Neville, Ann-Marie Pearce, Michael Rye, Edward Smith and Glynis Vince Smith declared non pecuniary interests in this item as they had signed the petition.  They remained in the meeting and took part in the debate on this item.

 

·                Councillor Jansev Jemal declared a Disclosable Pecuniary Interest.  She withdrew from the meeting and took no part in the consideration of this item.

 

Agenda Item 8: Opposition Business – Safeguarding the Green Belt from Residential Development

 

·                Councillor Joanne Laban declared a non-pecuniary interest as a result of her employment in the office of one of the Deputy Mayors for London.

 

·                Councillor Jansev Jemal declared a Disclosable Pecuniary Interest.  She withdrew from the meeting and took no part in the consideration of this item.

 

Agenda Item 15:  Motions

 

a.      Motion 15.3 (Trade Union Bill) in the name of Councillor Chibah:

 

·                The Mayor advised Members that following a request from the Leader of the Council the Monitoring Officer had agreed to grant a dispensation  under Section 33 (a) and (b) of the Members Code of Conduct for all members of the Majority Group in relation to the declaration of any disclosable pecuniary interest they may have relating to trade union sponsorship.  Members noted that declarations would still need to be made in relation to any interests not involving sponsorship.

 

·                Disclosable pecuniary interests were declared by Councillors Daniel Pearce (company engaged by Trade Union) and Claire Stewart (employed by a Trade Union).  Both Members withdrew from the meeting and took no part in the consideration of this item.

 

·                Non pecuniary interests were declared by Councillors Elaine Hayward, Robert Hayward and Michael Rye declared a non-pecuniary interest given their membership of a Trade Union.

 

b.      Motion 15.4 (Transatlantic Trade and Investment Partnership) in the name of Councillor Chibah – Councillor Michael Lavender declared a non-pecuniary interest given his employment by an American company.

 

c.       Motion 15.7 (London Living Wage) in the name of Councillor Sitkin -  non-pecuniary interests declared by Councillor Ertan Hurer (as an employer in borough) and Peter Fallart (due to the nature of his employment)

DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non pecuniary interests relevant to items on the agenda.

Minutes:

The Mayor invited John Austin (Assistant Director Governance Projects) to make a short statement relating to the declaration of interests in respect of Agenda Item 7: Opposition Business – The cost of temporary accommodation and what can be done about it:

 

Members were advised that notice had been received by the Monitoring Officer, signed by the Leaders of both Groups, requesting that a dispensation be granted enabling all members to participate in the debate and decision on this item at the Council meeting.  The request had been made in view of the number of members who would otherwise be prevented from participating in the debate due to them needing to declare a Disclosable Pecuniary Interest, on the grounds this was likely to (a) impede the transaction of business; and (b) so upset the representation of different political groups on Council as to alter the outcome of any vote.  Having considered the request the Monitoring Officer had agreed to grant the dispensation which it was noted would only apply for this meeting.

 

The following interest were declared in relation to other items on the agenda:

 

Agenda Item 8: Update on the Strategy for the Provision of Secondary School Places

 

·               Councillor Laban declared a Disclosable Pecuniary Interest as a close family member was employed as a headteacher of a Secondary School operating within the Borough.

 

Agenda Item 10: Establishing a Local Pensions Board

 

·               Councillor Maguire declared a Disclosable Pecuniary Interest as a full time employee of UNISON;

·               Councillor Stewart declared a  Disclosable Pecuniary Interest given the interest declared by Councillor Maguire as a “close family member”.

DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non pecuniary interests relevant to items on the agenda.

Minutes:

The Mayor invited John Austin (Assistant Director – Governance Projects) to make a short statement relating to the declaration of interests in respect of Agenda Item 7 (Budget 2015/16 and Medium Term Financial Plan 2015/16 to 2018/19 – General Fund) and Agenda Item 8: (Housing Revenue Account Estimates 2015/16 and Rent Setting – HRA & Temporary Accomodation).

 

Council noted:

 

1.      Under guidance issued by the Department of Communities and Local Government members would not be required to declare a Disclosable Pecuniary Interest (DPA) in relation to the budget or setting of the Council Tax.  This was on the basis that Council Tax liability would apply to the borough’s population as a whole, with councillors not having any unique position in that regard.  The requirements within Section 106 of the Local Government Finance Act 1992 would, however, still apply, which required any Member who was two or more months in arrears on their Council Tax to declare their position and not vote on any issue that could affect the calculation of the budget or Council Tax.

 

2.      The Councillor Conduct Committee (May 2013) had also granted a dispensation for all members in terms of the declaration of Disclosable Pecuniary Interests relating to the setting of housing rents

 

Subject to the requirements within Section 106 of the Local Government Finance Act 1992, this would allow all members to participate in the debate and vote on decisions relating to the setting of the Council Tax and Housing Rents.

 

Having noted the advice provided, the following declaration of interests were made at the meeting:

 

Agenda Item 10: Review & Adoption of Statutory Pay Policy Statement – the following members declared a Disclosable Pecuniary Interest:

 

·               Councillor Maguire as a full time employee of UNISON.

·               Councillor Stewart given the interest declared by Councillor Maguire as a close family member.

·               Councillor Lemonides as his spouse was a full time employee of the Local Authority.

·               Councillor Orhan as a relative was an employee of the Council.

 

Agenda Item 11: Exercising Discretion under the Local Government Pension Scheme

 

(a)    the following members declared a Discolsable Pecuniary Interest:

 

·                Councillor Maguire as a full time employee of UNISON.

·                Councillor Stewart given the interest declared by Councillor Maguire as a “close family member.

·                Councillor Lemonides as his spouse was a full time employee of the Local Authority.

·                Councillor Orhan as a relative was an employee of the Council.

 

(b)     As a result of clarification provided at the meeting regarding the scope of the report, the following members declared Non-Pecuniary Interests:

 

·                Councillor Achilleas Georgiou – as a member (not within Enfield) of the Local Government Pension Scheme.

DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non pecuniary interests relevant to items on the agenda.

Minutes:

The Mayor invited John Austin (Assistant Director Governance Projects) to make a short statement relating to the declaration of interests in respect of Agenda Item 9: Council Tax Support Scheme & Council and Business Tax Base 2015/16:

 

Council noted that under guidance now issued by the Department of Communities & Local Government members would not be required to declare a Disclosable Pecuniary Interest (DPA) in relation to the setting of the Council Tax, as local residents within the borough.

 

The exception to this guidance would, however, be any Member who was two or more months in arrears on their Council Tax.  Under Section 106 of the Local Government Finance Act 1992 any member in this position would still need to declare their position and not vote on any issue that could affect the calculation of the budget or Council Tax.

 

Having noted the advice provided, there were no declaration of interests.

Agenda Item 7: Opposition Business – Council approach to the delivery of new homes

 

·                Councillor Smith declared a Disclosable Pecuniary Interest as an employee of a Housing Association operating elsewhere in London.  He withdrew from the meeting for the duration of this item and took no part in the debate or final decision.

 

·                Councillor Fallart declared a non-pecuniary interest as a resident of Parsonage Lane, one of the seven small residential sites referred to in the Opposition Business Paper.  He remained in the meeting and participated in the decision on this item.

 

Agenda Item 9: Enfield 2017 – Transformation (Report No.104A & 105A)

 

·                Councillor Achilleas Georgiou declared a Disclosable Pecuniary Interest due to the employment of a family member by one of the Council’s partner organisations on the Transformation Programme.  He withdrew from the meeting for the duration of this item and took no part in the discussion or decision made.

 

·                Councillor Milne declared a Disclosable Pecuniary Interest due to his employment by an alternative supplier to one of the Council’s partner organisations on the Transformation Programme.  He withdrew from the meeting for the duration of this item and took no part in the discussion or decision made.

 

·                Councillor Alessandro Georgiou declared an other pecuniary interest as a family member owned a small company providing IT Support Services.  He remained in the meeting and participated in the discussion and decision on this item.

DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non pecuniary interests relevant to items on the agenda.

Minutes:

Councillor Elaine Hayward declared a non-pecuniary interest in relation to Agenda Item 7 (Strategy and Approach to Delivering Pupil Places) in respect of her role as a council nominated representative and vice-chair of the Pupil Referral Unit who were referred to within the strategy document.  She remained in the meeting and participated in the debate and decision on this item. Councillor Bernie Lappage declared a Disclosable Pecuniary Interest in relation to Agenda Item 8 (Lee Valley Heat Network Business Plan) as her spouse worked for one of the organisations listed as a potential key commercial partner for the Lee Valley Heat Network.  Councillor Lappage withdrew from the meeting for the duration of this item and took no part in the debate or final decision. Councillor Toby Simon declared a non pecuniary interest in Agenda Item 7 (Opposition Business) as he lived in one of the roads which would be affected by the traffic proposals relating to the Mini Holland scheme.

 

John Austin (Assistant Director, Corporate Governance) confirmed the interest registered was of a non-pecuniary nature, so he would be able to remain in the meeting and participate in any discussion and vote on this item.

Agenda Item 9: Council Tax Support Scheme 2014/15 – Members were reminded that the Councillor Conduct Committee (14 February 13) had granted a dispensation in relation to disclosable pecuniary interests and the Council Tax setting process.  The dispensation would apply until May 2014, so no members would be required to declare interests in relation to this item at the meeting.

 

Agenda Item 12.2: Motion in the name of Councillor Hamilton – Probation Service procurement process – Members were advised that if they owned shares, held employment, office, trade or other relationship for profit or gain in relation to G4S or any other company involved in the procurement process then they would need to declare a disclosable pecuniary interest in this item and withdraw from the meeting.  This would also apply if the same interest related to any family member or person with whom the member had a close association or personal relationship and the member was aware that they had such an interest.

 

Having noted the advice provided no declarations of interest were made by members at the meeting.

DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non pecuniary interests relevant to items on the agenda.

Minutes:

Councillors Del Goddard and CElaine Hayward declared an interest in Agenda Item 10 (Future Provision of Secondary Tuition Services) in their capacity as Chair and Vice-Chair of the Secondary Tuition Centre Governing Body.  John Austin (Assistant Director, Corporate Governance) confirmed the interest registered was of a non-pecuniary nature, so they would be able to remain in the meeting and participate in any discussion and vote on this item.

 

Councillor Bambos Charalambous also took the opportunity to declare, in respect of Motion 15.3 (Chickenshed) that all members of the Council had received two free tickets to attend a performance at Chickenshed Theatre.

DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non pecuniary interests relevant to items on the agenda.

John Austin, Assistant Director Corporate Governance, advised that any councillors who lived within a Controlled Parking Zone (CPZ) would need to consider whether they had an interest in relation to Motion 11.1 on the agenda (Resident Permit Parking Charges).  It was felt any interest would only qualify as an “other pecuniary interest” and members would therefore be able to remain in the meeting and participate in the debate and any vote on the item.

 

As a result of the advice received Councillors Toby Simon and Bambos Charalambous declared an “other pecuniary” interest in Motion 11.1, as residents living within a Controlled Parking Zone.

John Austin (Assistant Director Corporate Governance) reminded members of the requirements within the new Member Code of Conduct, relating to the declaration of interests.  The code had introduced a new category of disclosable pecuniary interests (DPIs) which in effect had replaced the previous category of prejudicial interests.

 

Members were advised that:

·              these interests extended not only to themselves but also to those of their spouse, partner, civil partner, family members or persons with whom they had a close association or personal relationship, and where they were aware that they had an interest.

·              when considering registering or disclosing any interests, they would still need to consider whether a member of the public, with knowledge of the relevant facts, would reasonably regard the interest as so significant that it would be likely to prejudice their judgement of the public interest and if so the interest should be declared.

·              If they considered they had a DPI or prejudicial interest in any matter being considered at the meeting they would need to declare that interest and must leave the meeting until the conclusion of the matter under discussion.  They would not be permitted to discuss or vote on the matter in question and would also need to ensure that the Monitoring Officer was notified of the interest (if not already declared), unless a dispensation had been granted.

Council is asked to note that the Councillor Conduct Committee (14 February 2013) agreed to grant a general dispensation under section 31 (4) (c) of the Councillor Code of Conduct allowing all members to participate in the debate and vote on decisions relating to the setting of the Council Tax, Housing Rents and Members Allowance Scheme.

John Austin (Assistant Director Corporate Governance) reminded members of the requirements within the new Member Code of Conduct, relating to the declaration of interests.  The code had introduced a new category of disclosable pecuniary interests (DPIs) which in effect had replaced the previous category of prejudicial interests, but had not exempted these requirements (as under the previous framework) in relation to decisions on the setting of Council Tax, Housing Rents & Members Allowances.

 

The Mayor advised that in order to enable members to participate in the debate and vote on the Council Tax, Housing Rents and Members Allowances scheme the Councillor Conduct Committee on 14 February 2013 had agreed to grant a general dispensation under section 31 (4) (c) of the Councillor Code of Conduct which would apply to agenda items 7 & 8.  This would allow all members to participate in the decision on these items and had been approved on the grounds that it would be in the interests of persons living in the Borough for as many members as possible to be able to debate and decide on the issues in question.

 

Confirmation was provided that Section 106 of the Local Government Finance Act 1992 would still require any Member who was two or more months in arrears on their Council Tax to declare their position and not vote on any issue that could affect the calculation of the budget or Council Tax (under agenda item 7).

 

Members were then asked to identify any interests in any other agenda items, with the following declarations made:

 

Agenda Item 9 : North Circular Area Action Plan Proposed Submission Stage - Councillor Oykener declared a Disclosable Pecuniary Interest as he was the landlord of a property in the area covered within the Plan.  He did not participate in the debate or vote and withdrew from the meeting for consideration of this item.

 

Agenda item 10 – Review & Adoption of Statutory Pay Policy Statement – Councillor Laban declared a Disclosable Pecuniary Interest as her mother was a Council employee.  This item was subsequently withdrawn from consideration at the meeting.

Given the number of enquiries from Members relating to potential DPIs in relation to Agenda Item 8 (Council Tax Local Support Scheme) the Councillor Conduct Committee had met on the 28 January 2013 to consider the granting of a general dispensation in relation to this item.  The Committee had agreed that the granting of any dispensation should be considered on an individual rather than general basis.  This would be based on the delegated authority available to the Assistant Director Corporate Governance to issue a dispensation on the grounds that the number of DPIs would mean that either:

·              the transaction of business would be impeded; or

·              the representation of different political groups on the Council would be so upset as to alter the outcome of any vote on the matter;

If the number of DPIs was not sufficient for the above conditions to apply then it would not be possible for the Assistant Director Corporate Governance to grant a dispensation and the members with the DPI would need to withdraw from the meeting and would not be able to participate in the discussion or vote on the item.

DECLARATION OF INTERESTS

Members of the Council are invited to identify any disclosable pecuniary other pecuniary or non pecuniary interests relevant to items on the agenda.

Minutes:

John Austin (Assistant Director Corporate Governance) advised members that as the Council had now approved the new Member Code of Conduct, all councillors would be required to comply with the new arrangements relating to the declaration of interests.  The code had introduced a new category of disclosable pecuniary interests (DPIs) which in effect had replaced the previous category of prejudicial interests.

 

Members were advised that:

·              these interests extended not only to themselves but also to those of their spouse, partner, civil partner, family members or persons with whom they had a close association or personal relationship, and where they were are aware that they had an interest including, as an example any issues relating directly to their employing organisation such as a school.

·              when considering registering or disclosing any interests, they would still need to consider whether a member of the public, with knowledge of the relevant facts, would reasonably regard the interest as so significant that it would be likely to prejudice their judgement of the public interest and if so the interest should be declared.

·              If they considered they had a DPI or prejudicial interest in any matter being considered at a meeting of the authority they would need to declare that interest and must leave the meeting until the conclusion of the matter under discussion.  They would not be permitted to discuss or vote on the matter in question and would also need to ensure that the Monitoring Officer was notified of the interest (if not already declared).

·              The new Code had also introduced the category of other pecuniary interests and other non pecuniary interests, which also needed to be declared at any meetings, although (in the case of non pecuniary interests) members could still remain and vote at meetings.

 

As a result of the advice provided the following interests were declared at the meeting:

a       Councillor Joanne Laban declared a pecuniary interest as one of her close relatives (brother) was employed by a free school in the borough.

 

She withdrew from the meeting during the consideration of this item.

 

b       Non pecuniary interests were declared by the following members as they were either school governors or had relatives employed in education in the borough - Councillors Catriona Bearryman, Lee Chamberlain, Bambos Charalambous, Andreas Constantinides, Denise Headley, Chris Murphy, Alan Sitkin, Edward Smith, Lionel Zetter and Ann Zinkin.

 

All of the above members remained in the meeting during the consideration of this item.

 

2.      Agenda item 12.3 – Motion relating to parking charges in Enfield Town

 

a.      Councillor Simon declared a non pecuniary interest as a resident living within Enfield Town.

In response to a request for advice, John Austin (Assistant Director Corporate Governance) advised members who were currently serving as Council appointed representatives on the Enfield Homes Board that they would need to consider declaring a non pecuniary interest in agenda item 8 (Housing Management Review), under paragraph 28 of the Council’s new code of conduct.  This was on the basis that they were in a position of general control or management on that body but had been appointed by the Council.  Any members who declared such an interest would, however, be permitted to, remain in the chamber and vote on the matter.

 

As a result, non pecuniary interests were declared by the following members on agenda item 8 – Housing Management Review as they were all Council appointed representatives on the Enfield Homes Board:

·              Councillor Chaudhury Anwar

·              Councillor Lee Chamberlain

·              Councillor Marcus East

·              Councillor Denise Headley

·              Councillor Tashin Ibrahim

All of the above members remained in the meeting during the consideration of this item and voted.

Minutes:

John Austin (Assistant Director Corporate Governance) advised members that as the Council had now approved the new Member Code of Conduct, all councillors would be required to comply with the new arrangements relating to the declaration of interests.  The code had introduced a new category of disclosable pecuniary interests (DPIs) which in effect had replaced the previous category of prejudicial interests.

 

Members were advised that:

·              these interests extended not only to themselves but also to those of their spouse, partner, civil partner, family members or persons with whom they had a close association or personal relationship, and where they were are aware that they had an interest.

·              when considering registering or disclosing any interests, they would still need to consider whether a member of the public, with knowledge of the relevant facts, would reasonably regard the interest as so significant that it would be likely to prejudice their judgement of the public interest and if so the interest should be declared.

·              The definition of what would now constitute a DPI had been set out in section 25 of the new Member Code of Conduct.

·              If they considered they had a DPI in any matter being considered at a meeting of the authority they would need to declare that interest and must leave the meeting until the conclusion of the matter under discussion.  They would not be permitted to discuss or vote on the matter in question and would also need to ensure that the Monitoring Officer was notified of the interest (if not already declared).

·              Failure to register a DPI could be a breach of the Code and a criminal offence.

·              The new Code had also introduced the category of other pecuniary interests and other non pecuniary interests, which also needed to be declared at any meetings, although (in the case of non pecuniary interests) members could still remain and vote at meetings.

 

In response to queries by members regarding potential interests on items due to be considered at the Council meeting, the Assistant Director Corporate Governance advised that guidance and case law was still awaited on the detailed interpretation of the new requirements.  Members would therefore need to apply the wording of the code as literally as possible and if they felt they had an interest, declare it at the meeting.

 

The following interests were declared in agenda item 7 - Opposition Business: Helping Enfield’s High Street Shops & Businesses

·              Councillor Tashin Ibrahim declared a disclosable pecuniary interest as he was an employee of Enfield Retail Business Association Ltd, providing advice to local businesses and retailers.

·              Councillor Toby Simon declared a disclosable pecuniary interest as a local resident with a property adjacent to Enfield Town CPZ.

Both members withdrew from the meeting during the consideration of this item and did not vote.

 

·              Councillor Chris Bond declared a non pecuniary interest as a council appointed representative on the Old Enfield Charitable Trust.

·              Councillor Yusuf Cicek declared a personal and prejudicial interest as a close relative held a disabled persons Freedom Pass;

·              Councillor Achilleas Georgiou declared a personal and prejudicial interest as a close relative held a disabled persons Freedom Pass;

·              Councillor Dino Lemonides declared a personal and prejudicial interest as a close relative held a disabled persons Freedom Pass;
