Declaration of Interests

Members of the Council are invited to identify any disclosable pecuniary, other pecuniary or non pecuniary interests relating to items on the agenda. 

Minutes:

NOTED

 

1.            The following interests were declared:

 

·           Councillor Taylor declared disclosable pecuniary interests in relation to items 9 and 10 on the agenda as a director of a Council company. 

·           Councillor Leaver declared disclosable pecuniary interests in relation to items 8 and 9 on the agenda as a director of a Council company.

·           Councillor Laban declared a non-pecuniary interest in relation to item 14 on the agenda as she served on some of the panels mentioned in the report.

·           Councillor Oykener declared a disclosable pecuniary interest in item 14 as a family-member worked for the Council. 

 

2.            The Mayor asked Jeremy Chambers (Director Law and Governance) to make a short statement on the declaration of interests’ requirements, in relation to agenda item 6 (Budget Report 2021/22) and Medium-Term Financial Plan) as follows: “in accordance with guidance from the Department for Communities and Local Government, there is no requirement for members to declare a disclosable pecuniary interest in relation to item 6.  The exception to this being any councillor who is two or more months in arrears on their Council Tax, in which case they will need to declare this and not take part in the vote.”  

 

3.            Jeremy Chambers confirmed that there were no councillors who were two or more months in arrears.

Minutes:

NOTED the statement from Jeremy Chambers, Monitoring Officer and Director of Law and Governance as follows:  

 

“In accordance with guidance from the Department for Communities and Local Government, there is no requirement for members to declare a disclosable pecuniary interest in relation to items 9 and 10.

 

The exception to this being any councillor who is two or more months in arrears on their Council Tax, in which case they will need to declare this and not take part in the vote.”  

 

Jeremy Chambers confirmed that there were no councillors who were more than two or more months in arrears. 

 

There were no declarations of interest.

Minutes:

Councillor Taylor and Councillor Leaver declared disclosable pecuniary interests in item 7 (Treasury Management Mid Year Report) as they were directors of Energetik.

Minutes:

Councillor Rye declared a non-pecuniary interest in Motion 1 and Councillor Taylor declared a disclosable pecuniary interest in item 10 (Reardon Court Extra Care Housing Scheme – Adjustment to the Capital Programme) as he was a director of Energetik.

Members of the Council are invited to identify any disclosable pecuniary, other pecuniary or non pecuniary interests relating to items on the agenda.

Before inviting members to declare any interests, the Mayor asked Jeremy Chambers (Director Law and Governance) to make a short statement on the declaration of interests’ requirements, in relation to agenda item 6 (Budget Report 2020/21 and Medium-Term Financial Plan). 

 

NOTED

 

1.            Under guidance issued by the Department of Communities and Local Government there was no requirement for members to declare a Disclosable Pecuniary Interest (DPA) in relation to item 6 on the budget or setting of the Council Tax. 

 

2.            The requirements within Section 106 of the Local Government Finance Act 1992 would, however, still applied, which required any Member who was two or more months in arrears on their Council Tax to declare their position and not vote on any issue that could affect the calculation of the budget or Council Tax.  No declarations in this respect were made at the meeting.

 

3.            Having noted the advice provided, the following interests were declared:

 

·         Councillor Mahym Bedekova declared a non-pecuniary interest in item 8 the Housing Revenue Account (HRA), Business Plan Budget 2020/21, Rent Setting and Service Charges. 

 

·         Councillors Oykener and Lemonides declared a disclosable-pecuniary interest in Item 11 (Review and Adoption of the Statutory Pay Policy Statement) as they had relatives who worked for the Council.

Minutes:

Jeremy Chambers made a statement in relation to declarations on the Council Tax reports. 

 

“In accordance with guidance from the Department for Communities and Local Government, there is no requirement for members to declare a disclosable pecuniary interest in relation to items 7 and 8.

 

The exception to this being any councillor who is two or more months in arrears on their Council Tax, in which case they will need to declare this and not take part in the vote.”

Minutes:

Councillors Brett, Laban, Milne, Orhan, Rawlings, Smith, Taylor and Vince declared non-pecuniary interests in item 7 on The Response to Climate Change Emergency and Motion 2 in the name of Councillor Vicki Pite.

·         Councillor Alex Georgiou declared a non-pecuniary interest in item 9. 

 

·         Councillor Rawlings declared a non-pecuniary interest in Motion 11.2 as a member of Greenpeace and Friends of the Earth.

Councillors Dey. Alessandro Georgiou and David Sanders declared a disclosable pecuniary interest in item 7 Opposition Business on empty shops as they worked in shops.

Minutes:

Councillor Joanne Laban declared a non-pecuniary interest in Motion 9.5 in the name of Councillor Orhan as her mother worked in a school which had been run by Carillion.

 

Councillor Alessandro Georgiou declared a non-pecuniary interest in Item 9.3 in the name of Councillor Laban on the extension of the Mayor of London’s Ultra Low Emission Zone as he worked for a company which had a client who was involved in the industry.

Members of the Council are invited to identify any disclosable pecuniary, other pecuniary or non pecuniary interests relating to items on the agenda. 

Minutes:

Before inviting members to declare any interests, the Mayor asked Jeremy Chambers (Director Law and Governance) to make a short statement regarding the declaration of interests’ requirements in relation to agenda item 7 Budget Report 2018/19 and Medium Term Financial Plan. 

 

NOTED

 

1.     Under guidance issued by the Department of Communities and Local Government members would not be required to declare a Disclosable Pecuniary Interest (DPA) in relation to the budget or setting of the Council Tax.  This was on the basis that Council Tax liability would apply to the borough’s population as a whole, with councillors not having any unique position in that regard.  The requirements within Section 106 of the Local Government Finance Act 1992 would, however, still apply, which required any Member who was two or more months in arrears on their Council Tax to declare their position and not vote on any issue that could affect the calculation of the budget or Council Tax.  No declarations in this respect were made at the meeting.

 

2.     The Councillor Conduct Committee (May 2013) had also granted a dispensation for all members in terms of the declaration of Disclosable Pecuniary Interests relating to the setting of housing rents.  Subject to the requirements within Section 106 of the Local Government Finance Act 1992, this would allow all members to participate in the debate and vote on decisions relating to the setting of the Council Tax and Housing Rents.

 

3.     Having noted the advice provided, the following interests were declared at the meeting:

 

·       Councillors Caliskan, Ekechi, Elif Erbil and Fonyonga declared disclosable pecuniary interests in Motion 10.9 in the name of Councillor Levy on NHS pay as they worked in the NHS.  

 

·       Councillor Alessandro Georgiou declared a non-pecuniary interest in Item 10.8 Motion in the name of Councillor Laban on the extension of the Mayor of London’s Ultra Low Emission Zone as he worked for a company which had a client who was involved in the industry. 

 

·       Councillor Laban declared a non-pecuniary interest in Motion 10.10 Motion in the name of Councillor Orhan as her mother worked in a school which had been run by Carillion.

Members of the Council are invited to identify any disclosable pecuniary, other pecuniary or non pecuniary interests relating to items on the agenda. 

Minutes:

Before inviting members to declare any interests, the Mayor asked Jeremy Chambers (Monitoring Officer) to make a short statement regarding a mayoral dispensation and the declaration of interests requirements, in relation to Item 8 (Council Tax Support Scheme and Tax Base).

 

The Monitoring Officer reported that, in accordance with guidance from the Secretary of State, there was no requirement for members to declare disclosable pecuniary interests in Item 8 on the agenda, even though they may pay council tax within the borough, or may be in receipt of council tax support. 

 

She advised that there was, however, a legal requirement for any member who was two months or more in arrears on their Council Tax to declare that fact and not vote on any issue that could affect the calculation of the budget or council tax more specifically.  No declarations were made in this respect.

Councillor Alessandro Georgiou declared a non-pecuniary interest in Item 13.8 Motion in the name of Councillor Laban on the extension of the Mayor of London’s Ultra Low Emission Zone as he worked for a company which had a client who was involved in the industry.

Minutes:

Councillor Alessandro Georgiou declared a non-pecuniary interest in Item 13.8 Motion in the name of Councillor Laban on the extension of the Mayor of London’s Ultra Low Emission Zone as he worked for a company which had a client who was involved in the industry. 

 

Councillor Abdul Abdullahi declared a non-pecuniary interest, as a school governor, in item 13.1 Motion in the name of Councillor Ayfer Orhan on the Government funding for education.

Councillor Oykener declared a disclosable pecuniary interest in Motion 10.4 in the name of Councillor Alev Cazimoglu on the crisis in social care and Councillor Alessandro Geogiou declared a disclosable pecuniary interest in Item 13.1 Motion in the name of Councillor Laban on the extension of the Mayor of London’s Ultra Low Emission Zone as he worked for a company which had a client who was involved in the industry. 


Meeting: 19/07/2017 - Council (Item 5)

Declaration of Interests

Members of the Council are invited to identify any disclosable pecuniary, other pecuniary or non pecuniary interests relating to items on the agenda. 

Minutes:

The Monitoring Officer reported that she had granted dispensations for all members under Section 33 (a) and (b) of the Members Code of Conduct in relation to the declaration of any disclosable pecuniary interest they had relating to agenda Item 13, Motions – motions 13.2 and 13.7 on housing issues and motion 13.3 on public sector pay. 

 

She had granted the dispensations on the basis that she had been satisfied that were likely to be sufficient members with a disclosable pecuniary interest which would adversely affect the transaction of business that evening.  The political representation in the chamber would be similarly affected so as to alter the outcome of any vote on the matter.  Members were informed that they would not have to declare their disclosable pecuniary interests on the motions listed and they would be able to remain in the meeting, take part in the debate and vote on these matters.  The dispensations were granted for this Council meeting only. 

 

Councillor Simon declared a non-pecuniary interest in item 10 on the Enfield Town Article 4 Directions as he lived within the Enfield Town conservation area and Councillor Alessandro Geogiou declared a disclosable pecuniary interest in Item 13.1 Motion in the name of Councillor Laban on the extension of the Mayor of London’s Ultra Low Emission Zone as he worked for a company which had a client who was involved in the industry.
