1.    The introduction by Claire Williams, Planning Decisions Manager, clarifying the proposals.

2.     The proposal seeks to accommodate an Aldi food store and a B&M retail store and provide 110 car parking spaces.

3.     It is important that development on the site does not prejudice the long-term aspiration for comprehensive redevelopment of the Western Gateway. The Section 106 legal agreement will therefore secure the temporary duration of the development to enable the unit to be vacated and the planning permission terminated for the comprehensive redevelopment to take place.

4.     In terms of transportation matters, the current site comprises 340 parking spaces. Officers have worked with the applicant to reduce the number of parking spaces on site to 110 given the current policy direction compared to decades past. The spaces will include 8 disabled parking bays, 2 active electric charging points and 2 passive electric charging points. A financial contribution of £10,000 will also been secured through a S106 to go towards pedestrian access improvements along Station Road.

5.     The prosed external changes to the building would not impact on the character and appearance of the area or neighbouring residential amenity and in fact improve the appearance of the existing building.

6.     The proposal would be a meanwhile use that will bring a currently vacant retail unit back into use, provide enhanced landscaping and cycling facilities, secure a financial contribution for pedestrian improvements, contribute to the local economy and generate jobs.

7.     Condition 3 has been amended as shown on the screen. This is to ensure that in the event that Aldi cease trading, retail sales on the site would revert to those approved under the previous permission reference 14/04636/VAR.

8.  The statement of Councillor Anne Brown, Southgate Green Ward Councillor, in support of the application.

9.  The statement of Councillor Daniel Anderson, Southgate Green Ward Councillor, in support of the application.

1.    The introduction by David Gittens, Planning Decisions Manager, clarifying the proposals.

2.    This application was considered at the 29 October 2020 committee meeting and had been deferred for the following reasons:

·         Affordable Housing consideration

·         Standard of accommodation regarding the 2 additional flats.

·         Amenity space

·         Replacement trees.

3.   Officers clarified the affordable housing contribution as £450,750 and not £405,750. The CiL contribution was also confirmed.

4.   The statement of Cllr Alessandro Georgiou, Cockfosters Ward Councillor.

5.    Members’ debate, and questions responded to by officers.

6.    The majority support of the committee for the officers’ recommendation with 7 votes for, 4 against and 1 abstention.

 

AGREED that planning permission be granted subject to a Section 106 agreement and subject to conditions.

1.    The introduction by Joseph McKee, Senior Planning Officer, clarifying the proposals.

2.    An update report, regarding the application, had been circulated to Members on the 16 October 2020.

3.    Members’ lengthy debate, and questions responded to by officers.

4.    Members questions included if there were any other types of performances other than films, noise issues, if there was enough space for  the stage as regards health and safety, why this was a retrospective application, how the applicants would deal with customers keeping their car engines on during winter months which affects climate change, ecological issues that may have an detrimental effect on wildlife i.e. illumination of the site, traffic concerns and measures that would be taken with queuing of cars into the cinema and traffic caused in nearby areas, how the applicants would address air conditioning issues from customers keeping their car engines on in summer months, what the potential and impact would be if flooding occurred on the site, why their were no comments from REACT, if tier 3 is imposed in the borough the impact of this to the cinema, staffing levels for the cinema and the conditioning of the 1:30 am finishing time.

5.  The unanimous support of the Committee for the officers’ recommendation.

1.    A Member site visit had taken place on 26 September 2020.

2.    The introduction by Graham Harrington, Principal Planning Officer, clarified the proposals.

3.    An update report had been circulated to Members containing minor corrections to the report. In addition, officers considered reasonable the applicant’s requested amendment to recommended Condition O1 that the last RMA shall be submitted no later than 12 years, rather than 10 years, from the date of permission.

4.    Receipt of a written representation in objection to the application from Councillor Mahmut Aksanoglu, circulated to all parties.

5.    The deputation of Matt Burn, resident.

6.    The response of Ben Wrighton, Turley (agent), and Brian Reynolds, BlackRock and NEAT Developments, on behalf of the applicant.

7.    Members’ lengthy debate, and questions responded to by officers.

8.    During the debate, it was AGREED that the rules of procedure within the Council’s Constitution relating to the time meetings should end (10pm) be suspended for a period of 30 minutes to enable the business of the agenda to be completed.

9.  The proposal of Councillor Rye, seconded by Councillors Anolue and Yusuf, that planning permission be refused on the grounds of the harm of tall buildings, housing need, and community facility re-provision was not supported by the majority of the Committee: 5 votes for and 6 votes against (including the Chair’s casting vote).

10. The support of the majority of the Committee for the officers’ recommendation: 6 votes for and 5 votes against (including the Chair’s casting vote).

11. During the vote, it was AGREED that the rules of procedure within the Council’s Constitution relating to the time meetings should end be suspended for a further period of 30 minutes to enable the business of the agenda to be completed.

12. Confirmation of the support of the majority of the Committee for the officers’ recommendation: 6 votes for and 5 votes against (including the Chair’s casting vote).

 

AGREED that

(1)  Subject to the completion of a S106 to secure the matters covered in the report and referral of the application to the Mayor of London (Stage 2) and no objection being raised, the Head of Planning / Head of Development Management be authorised to grant planning permission subject to conditions.

(2)  The S106 legal agreement referred to in resolution (1) above is to be completed no later than 31/12/2020 or within such extended time as the Head of Planning / Head of Development Management shall agree; and

(3)  Delegated authority be granted to the Head of Planning or the Head of Development Management to finalise the wording of the S106 obligations and the recommended conditions.
