RECEIVED the application made by Mr Ali Serbet for a new premises licence at the premises situated at Euro International, 212-214 Chase Side, Enfield, EN2 0QX.

 

NOTED

 

1.    The introduction by Ellie Green, Principal Licensing Officer, including:

 

a.    This was a new premises licence application, and the applicant was present at the hearing.

b.    It had come to her attention yesterday that the applicant wished to request an adjournment due to difficulties he had getting legal representation. Due to the late hour, she had advised that the applicant should come and make the request to the sub committee, but to be prepared also for the possibility for the hearing to proceed.

c.    Mr Serbet advised that he had many problems to deal with recently in respect of the premises, including financial, and when he found money for a solicitor it had been too late for representation at this hearing.

d.    Ellie Green clarified that Mr Serbet was the landlord of the premises and that the former tenants/licence holders had vacated without paying the bills. The application had come through an agent and it had originally been advised that a solicitor had been arranged. It was in the best interests of Mr Serbet to be legally represented, but that was not possible today. In the event of adjournment, there would be no licence in place and the premises would not be able to sell alcohol until a licence was granted. There had been Temporary Event Notice (TEN) applications which had covered 18 days. A premises was allowed 21 days under TENs per calendar year, so there could only be 3 more days maximum in 2019. The quota would start again from 1 January 2020, and TEN applications had already been submitted for 7 days. A further hearing would not be possible until the New Year when a meeting date would be arranged. There would be an impact on ability to sell alcohol at the premises.

e.    Mr Serbet confirmed his understanding of the situation, and that he was not selling alcohol at the premises at the moment.

 

2.    The Licensing Sub Committee agreed to the request for an adjournment. A decision would be made at a hearing at a later date.

Application for a new premises licence.

RECEIVED an application for a new premises licence for the premises known as VBO Lounge, Bar and Restaurant, situated at 1-3 Northampton Road, Enfield, EN3 7UL.

 

NOTED

 

1.    The introductory statement of Ellie Green, Principal Licensing Officer, including:

 

a.            The application was for a new premises licence by Vickbenok Limited.

b.            The licensing history of the premises as set out in section one of the report.

c.            The times that had originally been sought by the application and the amended times following agreement to representations from the Police and Licensing Authority as set out in section 2.4 of the report.

d.            Representations had been made by the Licensing Authority and Metropolitan Police to the original application seeking modification in conditions and reduction in hours, which had been agreed by the applicant. Those representations had now been withdrawn.

e.            Representations had been made, against the application, by 20 local residents; referred to as IP1 to IP20 in the report (Annex 2 of the report referred). The residents were representing Gilda Avenue and Duck Lees Lane. The grounds of representation were based on all four of the licensing objectives: prevention of crime and disorder, prevention of public nuisance, public safety and protection of children from harm. In the light of the amended times and conditions, IP10 had since withdrawn their representation.

f.             The applicant had provided a response to the objections, set out in Annex 3 of the report. In addition, the Directors of Vickbenok Limited, Victor Ben-Okoh and Carolyn Branson had organised a meeting for local residents to discuss their concerns and respond to issues raised. No residents had attended the meeting.

g.            No residents were in attendance at the hearing.

h.            The conditions arising from this application were set out in Annex 4 of the report.

 

2.    The statement of Victor Ben-Okoh, Director of Vickbenok Limited (applicant), including:

 

a.            The personal history and experience of Mr Ben-Okoh as referred to in Annex 3 of the report and outlined to Members at the meeting. It was noted that the premises aimed to be a bespoke hybrid venue designed for multi-purpose use.

b.            The application, as amended, now being sought, as set out in the report.

 

3.     The questions raised by the Sub-Committee and responses received, including:

 

a.            The Temporary Event Notices (TENs) that had previously been agreed for the premises as detailed in paragraph 1.8 of the report. In response to questions raised, it was noted that there had been no complaints or issues of concern raised in respect of these events.

b.            The most recent event had taken place on 5 August 2019. Mr Ben-Okoh reported that he had monitored the noise level from the premises and had found it to be significantly less than the noise caused by the traffic passing by the premises.

c.            In response to a question raised, it was confirmed that local residents had been provided with the business telephone number of the applicant.

RECEIVED the application made by Fancy Fair Markets Limited for the premises situated at Bramley Sports Ground, Chase Side, London, N14 4AB for a New Premises Licence.

 

NOTED

 

1.    The introduction by Ellie Green, Principal Licensing Officer, including:

a.    Fancy Fair Markets Limited had made an application for Land, Bramley Sports Ground, Chase Side, London, N14 4AB.

b.    The proposal was for the licence to be used annually with no more than four event days per year. This year, the proposed event was from Saturday 25 to Monday 27 May 2019 – the second May Bank Holiday weekend.

c.    The application sought a maximum capacity of 9,999 people at any one time.

d.    The application sought licensable activities Friday to Monday 10:00 to 22:00 and sale of alcohol 10:00 to 21:30, as amended through mediation.

e.    The officers’ report set out licensing hours at three nearby premises for information. This application was the first of any kind for this site.

f.     There had been 151 representations received from other persons, including local residents, sports associations and ward councillors, all against granting the application, and based on all four licensing objectives. Copies of the IP representations were set out in Annex 6 of the agenda. The road names of those objecting were listed in para 3.4 of the officers’ report.

g.    In response to the representations, the applicant provided documents set out in Annex 4, 7, 10 and 11 in the agenda.

h.    The Metropolitan Police and Licensing Authority sought the removal of alcohol off sales and modification of conditions. These were agreed by the applicant and subsequently the responsible authorities’ representations were withdrawn.

i.      Further conditions were also offered by the applicant. Annex 8 in the agenda set out the final list of proposed conditions.

j.      The proposals had been considered by the Safety Advisory Group (SAG), and an overview report was included as Annex 5 in the agenda.

k.    It was for the Licensing Sub Committee (LSC) to determine whether the application supported the licensing objectives.

l.      The applicant was represented by Counsel Sarah Le Fevre. The Festival directors were also present, as well as the Event Management and Safety Consultant, and the Principal Consultant, Big Sky Acoustics Ltd.

m.  Local residents making objections were referred to as IP reference numbers. 24 had confirmed their attendance at the hearing and more were also present. The spokespeople were confirmed as Peter Basham and Beverley Spinks. Councillor Edward Smith, Cockfosters Ward Councillor, was also present to represent the objectors.

n.    In response to the Chair’s query, Ellie Green confirmed recent case law in respect of the ruling in the case of ‘AEG Presents Limited v London Borough of Tower Hamlets’. RECEIVED the application made by A Man About A Dog Limited (AMAAD) for a new Premises Licence at the premises known as and situated at Trent Park, Cockfosters Road, EN4 0PS.

 

NOTED, that Councillor Chris Bond (Chair) referred to the ruling of the case of “AEG Presents Limited v London Borough of Tower Hamlets”. Councillor Bond stated that he did not have the powers to apply a time limited licence when the applicant sought an indefinite licence. If the sub-committee was satisfied that the conditions, times and activities were suitable for one year, they should be strong enough to grant the licence for any period of time – the test was the same, regardless of the length of period of a licence. The review processes were also noted as detailed in the minutes below.

 

1.    The introductory statement of Ellie Green, Principal Licensing Officer, including:

 

a.    The application was for a new premises licence by A Man About a Dog Limited (AMAAD) for Trent Park, Cockfosters Road, EN4 0PS. The premises licence did not seek to be time limited. The application sought to operate annually with two event days taking place over one weekend but this year the event would last for one day only. The maximum capacity at any one time was 24,999. The operating hours and conditions were as set out in the report of the Principal Licensing Officer and the annexes attached to the report; and were outlined in detail at the meeting.

b.    The history of the premises licences held at Trent Park and examples of previous large scale events were highlighted as set out in the report. This application was for the largest capacity to date.

c.    Representations had been made, against the application, by 25 local residents, resident groups and park groups, and were referred to as IP1 to IP26 (IP18 had been withdrawn) and were attached as Annex 13 of the report. The grounds of representation had included the prevention of crime and disorder; the prevention of public nuisance; public safety and the prevention of children from harm. The Licensing Authority had not made any representations in respect of this application. The Metropolitan Police had made representations in respect of this application, namely seeking modification of conditions. The applicant had agreed those conditions, and subsequently the representation had been withdrawn.

d.    Annexes 6 to 11 of the report were noted.

e.    Annex 14 set out the proposed conditions.

f.     Enfield’s Safety Advisory Group (SAG) had produced a report for the Licensing Sub-Committee which was set out in Annex 12 of the report.

g.    That the address provided by the applicant had been amended to the address registered at Companies House, as set out in the report.

h.    That the following persons were present at the hearing on behalf of the applicant:

RECEIVED the application made by Star Pubs & Bars Limited for the premises situated at The Hop Poles Public House, 320 Baker Street, Enfield, EN1 3LH for a Variation of a Premises Licence (LN/200502201).

 

NOTED

 

1.    The introductory statement of Ellie Green, Principal Licensing Officer, including:

a.    The application was for variation of a premises licence held by Star Pubs & Bars Ltd for the Hop Poles public house.

b.    The pub was located in a mixed commercial parade on a busy road and with surrounding residential properties.

c.    The pub had been operating since before 2005.

d.    The application sought extension of hours for licensable activities until 02:00 latest at weekends: this would be an extra two hours for alcohol sales and music, and an additional one hour during the week. This would equate to a reduction in part as the pub was currently able to open 24 hours a day.

e.    A number of representations had been received: from the Police, the Licensing Authority and three others referred to as IP1 to IP3, who were local residents. There was also a representation in support received from IP4, who was also a local resident.

f.     The parties had not been able to reach agreement on all conditions or hours sought.

g.    Mediation had continued between the applicant and the Licensing Authority and the Police, and details of the hours sought were set out on page 1 of the supplementary agenda pack.

h.    The Responsible Authorities made representation on Prevention of Crime and Disorder; Protection of Children from Harm; and Prevention of Public Nuisance. The residents making representation against the application objected to it in its entirety, as set out in Annexes 5 to 7.

i.      The representation in support was set out in Annex 8.

j.      The Licensing Authority had received more representations, but these had either been invalid or out of time or no further information brought forward, but they had still been brought to the attention of the applicant for information.

k.    The final list of conditions agreed were set out in the supplementary agenda pack. Conditions 1 to 16 were agreed by all parties. Conditions 17 to 22 were not yet agreed, in addition to consideration of the final hours.

l.      Representatives of the Police sent apologies they were unable to attend the hearing, but had nothing further to add to the written representations.

m.  IP1, IP3 and IP4 were not in attendance, but equal consideration should be given to representations in writing or provided orally today.

 

2.    The statement of Charlotte Palmer, Licensing Enforcement Officer, including:

a.    She was pleased to see some conditions agreed, and times specified.

b.    The Licensing Authority agreed to the start times, but recommended a terminal hour of 01:00 rather than 02:00.

c.    This premises was not located in a town centre. There were many residential properties in the surrounding area.
