KD 3767 Article 4 Direction Review

Domestic properties have permitted development rights allowing owners to carry out a range of development works without planning permission. Such works can have a harmful effect on the character or appearance of a conservation area leading to the erosion of their special interest. The Council has already removed many of these rights by serving an Article 4 Direction.

This report recommends that permitted development rights to install domestic micro generation equipment including solar PV or solar thermal equipment and wind turbines be withdrawn from domestic properties (houses and flats) within the Lakes Conservation Area as a pilot.

It further recommends that future decisions to serve Article 4 Directions to remove any permitted development rights across the borough be decided by Planning Committee
